Agreements with Native Communities

CONTRIBUTION AGREEMENT ON FORESTRY RELATED MATTERS

BETWEEN:
THE LISTUGUJ MI’GMAQ BAND COUNCIL, represented by its Chief, Ronald Jacques (hereinafter referred to as Listuguj),

AND:
THE GOVERNMENT OF QUÉBEC, represented by Guy Chevrette, Minister of State for Natural Resources and Minister for Native Affairs (hereinafter referred to as Québec).

WHEREAS the gouvernement du Québec, intends to demonstrate its determination to reach and immediate and peaceful solution to the conflict;

WHEREAS it is opportune, for this purpose, to conclude an additional agreement to the one signed last August 9, 1998.
GIVEN the proposal presented to the Listuguj community members on August 13, 1998.

The parties agree as follows:

  1. The preamble is an integral part of the agreement.
  2. Objective of the agreement

    To further contribute to the economic development of the Listuguj community, to create jobs for its members and to ensure lasting solution of the conflict.
  3. Terms and conditions

  4. 3.1 Québec will ensure the creation and financing of 15 community jobs for a 26-week period to carry out various types of work within the community, this represents a financial contribution in excess of $100,000,00.
    3.2 Québec pledges to put an amount totalling up to $100,000,00 at the disposal of the community to carry out forest management work within the territory covered by the CAF, or the equivalent of 10 seasonal jobs. The work will be financed using available cutting rights credits of the forest companies established in the region.

4. Scope and interpretation

    4.1 The present agreement is concluded without prejudice to any future negotiations that might be carried out with the Mi’gmaq Nation with regard to land and resources, within the framework of a global territorial negociation.
    4.2 The present agreement does not define, limit, acknowledge or create ancestral rights or treaty rights, and it does not adversely affect them. Nor should it be interpreted as an agreement or a treaty within the meaning of section 35 of the Constitution Act 1982.

5. Duration of the agreement

    5.1 The present agreement will have a duration of 12 months and it will become effective on the day it is signed by the parties.
    5.2 After six months of implementation, the present agreement will be assessed by both parties and adjusted, if necessary, with both their consent.
